BYD sues the United States over Trump era tariffs

Chinese electric vehicle giant BYD filed a lawsuit in the United States challenging import tariffs introduced under Donald Trump. The company argues that the US government overstepped its authority and relied on legislation that does not permit the imposition of broad based import duties.

BYD brought the case before the United States Court of International Trade, claiming that the International Emergency Economic Powers Act does not grant the president the power to impose general import tariffs. That law formed the legal basis used by the Trump administration in 2025 to introduce new trade barriers.

The company is seeking the annulment of the tariffs and the repayment of import duties paid since 2025. While BYD does not sell passenger cars in the United States, it maintains a presence through electric buses, trucks, and battery systems.

A case with wider implications

The lawsuit goes well beyond a single manufacturer. Similar legal actions were filed by other companies, and a ruling in BYD’s favour could have consequences for US trade policy as a whole. In an automotive industry shaped by electrification and global supply chains, the case may define how freely the US executive branch can impose import tariffs in the future.

For BYD, the legal move is about principle as much as money. For Washington, it could become a test of how far emergency powers stretch once they collide with long term industrial policy.
